In the very near future, breach readiness in Canada will take on a whole new meaning. New federal regulations regarding mandatory notification, reporting and record keeping of privacy breaches under Canada’s federal data protection law, the Personal Information Protection and Electronic Documents Act (PIPEDA), will come into effect on November 1, 2018.
Starting November 1st the new regulations will detail:
- Details on record keeping in relation to breaches
- What breaches require notification
- Who needs to be notified of the breach
- When notification needs to happen
- How the notification needs to be delivered
Organizations will be presented with new risks, costs, and challenges including:
- incident response
- compliance
- legal risk management
- additional liability and regulatory exposures.
